Is there a rent cap?
No, there is no rent cap.
In manufactured and mobile housing, counties, cities, including charter cities, or towns do not have the power to control rents. ARS 33-1416.
The Private Property Rights Protection Act passed in 2006 protects property owners from rent caps that would diminish the value of their property. ARS 12-1134.
How often can my rent go up?
In manufactured and mobile housing, your rent can go up every time your lease renews or every 90 days if you do not have a lease. ARS 33-1476.
In RV parks, on the expiration or renewal of any rental agreement, the landlord may increase or decrease the total rent or change payment arrangements. The landlord shall notify the tenant in writing by first class or certified mail or by personal delivery at least sixty days before the expiration or renewal of any rental agreement of any such increase or change. ARS 33-2105.
Do I need a lease?
With a lease agreement, you are guaranteed that your rent won’t go up until your lease expires. Either party may request a lease agreement for up to 4 years. ARS 33-1476 and 33-2105.
Do tenants have rights?
Yes.
The Arizona Mobile Home Parks Residential Landlord and Tenant Act (LTA) governs landlord and tenant’s rights and obligations under Title 33, Chapter 11.
The Arizona Recreational Vehicle Long-Term Rental Space Act (AZ RV ACT) governs landlord and tenant’s rights and obligations under Title 33, Chapter 19. You must be a long-term resident for 180 consecutive days in that park.
Are trees and other vegetation the responsibility of the park or the tenant?
In manufactured and mobile housing, after December 31, 2016, the landlord shall specifically disclose in writing the requirements for the tenant to maintain one or more existing trees on the site. ARS 33-1434.
Am I protected against retaliation and discrimination?
Yes. Landlords, managers, and tenants are protected by law. You can report to Adult Protective Services, get an Injunction Against Harassment or an Order of Protection, file a petition with the Arizona Department of Housing, or file a complaint with the Arizona Attorney General’s office. ARS 33-1491 and 33-2148.
